Terms and Conditions for all Rentals and Services

1. Introduction

These Terms and Conditions govern the rental of pickleball-related items, including ball machines, ball hoppers, ball tubes, ball baskets, training aids, pickleballs, and other accessories (hereinafter referred to as "Equipment"). By renting Equipment from Pickleball Edge LLC ("Company"), you ("Renter") agree to be bound by the terms outlined in this document. Please read carefully before entering into a rental agreement.

2. Rental Period

  • The rental period begins on the date the Equipment is picked up or delivered to the Renter and ends on the agreed-upon return date.
  • Any extension of the rental period must be agreed upon in writing by the Company before the initial return date.

3. Rental Fees and Payment

  • Rental fees are calculated based on the duration of the rental and the type of Equipment rented. All fees are outlined in the rental agreement.
  • Payment for the full rental period is due at the time of reservation or upon pickup, unless otherwise specified.
  • Late returns will incur additional charges, which will be outlined in the rental agreement.

4. Deposit

  • A refundable deposit may be required for certain Equipment. The deposit amount will be specified at the time of booking.
  • The deposit will be refunded to the Renter upon the return of the Equipment in the same condition as when it was rented, minus any applicable fees for damage, loss, or cleaning, as determined by the Company.

5. Renter’s Responsibilities

  • Proper Use: The Renter agrees to use the Equipment only for its intended purpose and in a safe and responsible manner.
  • Care: The Renter is responsible for taking care of the Equipment during the rental period and ensuring it is returned in good working condition.
  • Damage or Loss: The Renter agrees to cover the costs of any damage or loss of Equipment that occurs during the rental period. This includes costs for repairs, replacement, or cleaning if the Equipment is returned in a condition worse than at the start of the rental period.
  • Inspection: It is the Renter’s responsibility to inspect the Equipment at the time of pickup or delivery to ensure it is in good working condition. Any defects or issues should be reported to the Company immediately.

6. Company’s Responsibilities

  • Equipment Condition: The Company agrees to provide the Equipment in good working order, free from defects that could affect its intended use.
  • Support: The Company will provide basic instructions for the use of the Equipment, upon request, and may be available to assist with any questions or issues during the rental period but is in no way or form obligated to provide this support due to any reason.

7. Cancellation Policy

  • Cancellations made more than 48 hours before the start of the rental period are eligible for a full refund.
  • Cancellations made less than 48 hours before the rental period will be subject to a cancellation fee of 50% of the reservation cost, or as outlined in the rental agreement.
  • No Show / No Refund: Refunds cannot be issued for any items which are reserved but not picked up at the pickup time.

8. Liability and Indemnification

  • The Company is not liable for any injuries, damages, or losses that occur as a result of using the rented Equipment. The Renter assumes all risk of injury or damage that may occur from using the Equipment.
  • The Renter agrees to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from the use of the Equipment during the rental period.

9. Damage, Loss, and Theft

  • If the Equipment is damaged, lost, or stolen during the rental period, the Renter agrees to pay for the repair or replacement costs as determined by the Company.
  • In case of theft, the Renter must immediately report the incident to local authorities and provide a copy of the police report to the Company.

10. Return of Equipment

  • The Equipment must be returned by the agreed-upon return date and in the same condition as it was provided, normal wear and tear excepted.
  • Rental returns have a grace period of 15 minutes to account for any unexpected delays, but any returns after that will incur a Delayed Return Fee of $25.
  • If the Renter fails to return the Equipment, the Company reserves the right to charge the Renter for the full replacement cost of the Equipment.

11. Termination

  • The Company reserves the right to terminate the rental agreement at any time if the Renter breaches any of the terms outlined in this agreement.
  • Upon termination, the Renter must return all rented Equipment immediately.
  • Prices for our products are subject to change without notice.We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

12. Accuracy of Billing and Account Information

  • The Company reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
  • In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be invalid or fraudulent or non-serviceable.

13. Governing Law

  • These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United States.

14. Entire Agreement

  • This document constitutes the entire agreement between the Company and the Renter regarding the rental of Equipment. Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
